Terms and conditions for Peer-to-Peer Transfers  (the “Service”)

Your use of this Service is subject to the general NALA terms of Service based on your country of residence. The specific terms governing use of the Service are provided below. Use of the Service is optional. By using the Service you agree to be bound by these terms and conditions. We may suspend or terminate your access to NALA, or close your account, if you breach these terms and conditions.

‍Description of Service

The Service allows you as a NALA customer to send funds or receive funds from other NALA customers within the NALA platform. You may use the Service solely for personal, non-commercial purposes. 

Accessing the Service

To use the  Service simply select the recipient from your contacts list or use their NALA username (hereinafter known as a “NALA Tag”). The recipient's NALA Tag remains consistent even if they change their phone number, enhancing the accuracy of transfers.

Your chosen NALA Tag must not include any offensive, profane, or discriminatory language, including but not limited to racism or sexism. If we find your NALA Tag to be inappropriate, we reserve the right to suspend or terminate your account. You acknowledge and agree that we will collect, process, and store your personal data for the purposes of providing the Service and complying with legal and regulatory requirements. You have the right to access, rectify, and erase your personal data and to object to its processing, in accordance with the relevant data protection laws. We will not share your personal data with third parties without your consent, except as required by law or as described in our Privacy Policy.

Initiating payment instructions

As a party initiating a transfer (“Sender”), you can transfer funds to your selected recipient (“Recipient”) by (i) logging into your NALA Account, (ii) designating the Recipient by entering their NALA Tag or phone number, (iii) indicating the amount of money you want to send, and (iv) selecting the confirmation action (a “Transfer Instruction”). Once you have confirmed the Transfer Instruction, you authorise us to debit funds from your digital wallet, your linked bank account, or your linked debit card, and transfer them to the designated Recipient (a “Transfer”). 

You understand and agree that when you initiate a Transfer the funds will immediately be deducted from your selected funding method. The first time you instruct a Transfer to a new Recipient, the Recipient will need to accept the Transfer within the NALA app. If a Recipient does not accept the Transfer within thirty (30) days, it  will be  automatically canceled. By initiating a Transfer, you are authorising us to move funds back to your digital wallet, bank account or debit card, in the event of an automatic cancellation. If we are not able to return funds to your original funding method, we may use other reasonable means to return the transfer to you, as permitted by Applicable Law.

You may also initiate a request for funds to be transferred to you by designating the amount of funds requested and your selected Sender (a “Funds Request”). If the Sender approves your Funds Request, your Funds Request will become the Sender’s Transfer and be processed as described above. 

All Transfers received will be stored in your digital wallet . You can use funds in your digital wallet for future Transfers or to fund another payment type in accordance with the NALA Terms of Service.

Canceling payment instructions

Our ability to stop or cancel a Transfer depends on how the Transfer was initiated, and whether the Transfer has been fulfilled. You cannot cancel a Transfer once it has been accepted by a Recipient. If a Transfer is canceled before funds have been accepted by the Recipient, we will attempt to return your funds. By submitting a cancellation request, you are authorizing us to move funds back to your digital wallet, bank account or debit card, as applicable.

Non-NALA customers

You can send money to or request money from a friend, even if they don’t have a NALA account at the time you send the payment, using their email address or NALA Tag. If the friend does not have a NALA account, they can open a NALA account and accept the transfer. If the friend does not accept the transfer within thirty (30) days, the transfer will be canceled. ‍Funds in your wallet balance can be withdrawn into a bank account linked to your account.

Limits on transfers

We may impose transaction limits on transfers in our reasonable discretion for the purpose of mitigating risks of illegal activity, unauthorized usage or fraud. These may include limits on the timing, size, volume, Recipient of any attempted transfer. We may require additional identification information in order to accept instructions for a transfer exceeding any such limits. We may adjust these limits at any time in our reasonable discretion, with or without notice to you.

Liability

You agree that we shall incur no liability if we are unable to complete any transfer because of: (i) insufficient funds in your digital wallet, linked bank account, or linked debit card; (ii) malfunction of the NALA app due to circumstances beyond our control or due to circumstances that you were already aware of at the time you initiated your Transfer; (iii) an inaccurate or insufficient Transfer Instruction; or (iv) failure of the Recipient to accept the Transfer.

Compliance with laws and regulations
NALA  reserves the right to block, refuse, or reverse any Transfer made under these terms where it reasonably believes that it must do so: (i) to protect the security of your NALA Account, (ii) if there is suspected unauthorised or fraudulent use of your NALA Account, (iii) you are in breach of the NALA Terms of Service , or (iv) NALA has reasonable grounds to believe the transaction is unlawful. 

You agree to comply with applicable laws and regulations relating to the use of this Service including but not limited to those concerning money laundering and fraud prevention. You must not use the Service for any illegal activities including but not limited to gambling, drug trafficking or unlicensed money transmission.

You may opt out of the service at any time by contacting us via mamanala@nala.com. Upon opting out will be removed from the Service together with any information associated with your account in the platform.


Fees

We reserve the right to charge fees associated with the Service  at any time subject to these Terms and with prior written notice to you.

Indemnification

You agree to indemnify and hold Nala harmless from any and all claims, damages, losses, and expenses arising from your use of this Service, to the fullest extent permissible under the law. This includes any legal fees incurred by NALA in defending against such claims.ur ability to stop or cancel a P2P Payment Instruction depends on how the Payment Instruction was initiated, and whether the Payment Instruction has begun processing. We are not required to stop, cancel, or recover funds associated with a misdirected Payment Instruction.The first P2P Payment not accepted  by a Recipient seven (7)  days after the processing has begun will be canceled automatically. We will attempt to return any refused, refunded, prohibited, or denied P2P Payment to your account, as applicable. After the first payment to a Recipient has been successfully approved further payments to the same Recipient will be automatically processed upon issuance of the Payment Instruction.Â
